Terms of Service
These terms are the agreement between you and PixelForge AI. They cover your account, what you can and cannot do, how plans and billing work, who owns the images you create, and the limits of our liability. Please read them - using PixelForge means you accept them.

1. Acceptance of these terms
By creating an account or using PixelForge AI (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.
2. Eligibility
You must be at least 16 years old (or the minimum age of digital consent where you live) and legally able to enter into a contract. You may not use the Service if you are barred from doing so under applicable law or sanctions.
3. Your account
You are responsible for the accuracy of your account information and for keeping your credentials secure. Authentication is handled by Clerk. You are responsible for all activity under your account. Tell us promptly at support@pixelforgeai.dev if you suspect unauthorised use.
4. Acceptable use
You agree not to use the Service to create, upload, or distribute content that:
- is illegal, or that promotes or facilitates illegal activity;
- infringes anyone's intellectual property, privacy, publicity, or other rights;
- depicts sexual content involving minors, non-consensual intimate imagery, or content that sexualises real identifiable people without consent;
- is harassing, hateful, defamatory, or incites violence, or that creates deceptive deepfakes or impersonations intended to mislead;
- attempts to reverse engineer, scrape, overload, or circumvent the Service, its rate limits, or its security; or
- violates our License or any applicable platform, advertising, or model-provider policy.
We may remove content, and suspend or terminate accounts, that breach these rules. You are responsible for the prompts you submit and the outputs you generate.
5. Free tier, credits, subscriptions, and billing
- Free tier - we offer a free tier so you can try the Service before paying. Its limits may change over time.
- Credits - some actions (such as high-resolution downloads or generations) consume credits. Credits have no cash value, are non-transferable, and may expire as described at purchase.
- Subscriptions - paid plans renew automatically (monthly or yearly) until cancelled. You can cancel any time from your account; cancellation takes effect at the end of the current billing period.
- Payments - billing is handled by Stripe. By subscribing you authorise recurring charges to your payment method. Prices may change with notice; changes apply to the next billing cycle. You are responsible for applicable taxes.
6. 30-day money-back guarantee and refunds
We stand behind PixelForge with a 30-day money-back guarantee on your first paid subscription: if you are not satisfied, contact us at support@pixelforgeai.dev within 30 days of your initial purchase and we will refund that payment. One-time credit top-ups and any credits already consumed [[ confirm refund treatment of consumed credits / top-ups ]] may be excluded. Where you have a statutory right of withdrawal (for example as an EU/UK consumer), that right applies in addition to this guarantee.
7. Image ownership and intellectual property
As between you and PixelForge, you own the images you generate for your own use, subject to these terms and to the rights of any third party. Your rights to use, share, and commercialise images are governed by the PixelForge Free License - read it for the full scope and the limited restrictions (for example, you may not repackage images as a competing stock library).
The Service itself - our software, branding, design, and content (other than user-generated images) - belongs to PixelForge and its licensors and is protected by intellectual property law. We grant you a limited, revocable, non-exclusive licence to use the Service per these terms; we reserve all rights not expressly granted.
8. Your content and responsibility
You retain ownership of the prompts and content you submit. You grant us the rights we need to operate the Service - to host, store, process, and display your content, and to send it to our model and storage providers to generate and deliver results. You represent that you have the rights to submit your content and that it does not violate these terms or the law.
9. AI-generated output - important disclaimers
PixelForge produces AI-generated images. You acknowledge and agree that:
- outputs are generated automatically and may be inaccurate, unexpected, or similar to outputs produced for other users - we do not warrant accuracy, fitness for a particular purpose, originality, or uniqueness;
- images are not photographs of real people, brands, or products, and any resemblance to a real person, trademark, or protected work is unintentional; and
- you are responsible for reviewing each output and for clearing any third-party rights - including trademark, copyright, publicity, and likeness rights - before you use it, especially in commercial, sensitive, or regulated contexts.
10. No warranty
The Service and all outputs are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, PixelForge and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded by law (such as for fraud or for death or personal injury caused by negligence). Mandatory consumer rights are not affected.
12. Indemnity
You agree to indemnify and hold harmless PixelForge and its founder from claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, your content or generated images, or your breach of these terms or of any third-party right.
13. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) continue to apply.
14. Governing law and disputes
These terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. The courts of [[ place of jurisdiction in Switzerland ]] have exclusive jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence. PixelForge is Made in Switzerland.
15. Changes to these terms
We may update these terms as the Service evolves or the law changes. We will revise the "Last updated" date and, for material changes, give reasonable notice. Continued use after an update means you accept the revised terms.
